South Dakota’s insurance industry is regulated under Title 58 of the South Dakota Codified Laws, outlining policy requirements and claim procedures to protect all insurance consumers in the state.

A 10-day “free look” period is one such protection, allowing new life insurance policyholders a minimum of ten days to review their policy and cancel it for any reason. Insurers are obligated to refund all paid premium.

All life insurance claims must be settled within two months of receiving the proper proof of death. Individual insurers will have their own procedures which can be found in the text portion of your policy.

Your insurer cannot share any medical information about you with any other insurer. However, if you were to ask for medical information, the insurer must honor your request.

Title 58 extends some protections for insurers, as well as consumers. If any fraudulent or misleading statements are found on a life insurance policy or application for coverage within the first two years of a policy’s life, the insurer may terminate the policy and not honor any claims. Misstatements of age may be discovered at any time during the life of the policy and will result in a recalculation of death benefits, reflecting the correct age of the insured.

Suicide is exempt from a life insurance claim during the first two years of a policy’s life. All premiums paid will, however, be refunded.

An agreement made between an insured individual and a third party in which the third party “buys” a life insurance policy from the insured, making all premium payments, is called a Viatical Settlement. In return, the third party becomes the policy’s beneficiary. Viatical settlements are legal in South Dakota, but are regulated by the Securities Division.

As long as your life insurance company is licensed in South Dakota and your premiums are current, your policy will be backed financially be the South Dakota Life & Health Insurance Guaranty Association. In the event that your insurer becomes bankrupt, the Guaranty Association will help to compensate your lost policy. $300,000 is the death benefit compensation limit per insured. This maximum holds true, no matter the number of or value of an insured’s policies.
